The All-China Federation of Industry and Commerce (ACFBI) is a people's organization and chamber of commerce under the leadership of the Communist Party of China (CPC) for the industrial and commercial circles, with non-public enterprises and non-public economic personnel as the main body. It serves as a bridge between the Party and the government to contact non-public economic personnel, and an assistant to the government in managing and serving the non-public economy. The work of the Federation of Industry and Commerce is an important part of the united front work and economic work of the Communist Party of China.

Functions and tasks

(1) Participate in the tripartite meeting on the coordination of labor relations, work with representatives of human resources and social security departments, trade union organizations and other relevant enterprises to jointly promote labor relations legislation and the construction of labor relations coordination mechanisms, and jointly study and solve major problems in labor relations and mediate labor disputes.
(2) Guide non-public enterprises to conduct equal consultations with trade unions in accordance with the law on issues concerning the vital interests of employees, such as wages, living benefits and social insurance, and sign collective contracts.
(3) To coordinate and handle the relationship between the interests of investors and the rights and interests of workers, guide non-public enterprises to establish harmonious labor relations, actively create jobs, strictly abide by the relevant laws, regulations, policies and measures of the State, respect and safeguard the legitimate rights and interests of employees, establish trade union organizations and carry out trade union activities in accordance with the law.
Article 6 Represent and safeguard the legitimate rights and interests of members, reflect the opinions, requirements and suggestions of members, and participate in the mediation and arbitration of economic disputes.

Article 8 Enterprises, organizations and individuals who recognize the articles of Association and fulfill the obligations of membership may apply to join the Association.

The main body of enterprise members is non-public enterprises, mainly including private enterprises, limited liability companies and joint stock limited companies controlled by non-public economic components, Hong Kong and Macao investment enterprises, etc.
(2) The association of private enterprises with legal personality, individual workers' association, foreign investment enterprise association, township enterprise association, trade association, trade chamber of commerce, chamber of commerce in different places and other relevant social organizations shall be group members of the Association after the application for membership is approved.
(3) Investors and operators of private enterprises, Individual industrial and commercial households After the application for membership is approved, he shall be an individual member of the Association;
Persons who are in contact with the work of the Association and persons from the industrial and commercial sectors of Hong Kong and Macao investing in the Mainland may apply for or be invited to become individual members of the Association;
Units that have established working relations with the Association may, through consultation, select representatives to participate in the Association as individual members;

Article 9 The principle of voluntary membership and free withdrawal shall be implemented.
Industry and commerce federations at all levels may, in accordance with the provisions of these Articles of Association and the actual situation, formulate specific membership conditions and procedures for entering and leaving the association, and report them to the industry and commerce federations at the next level for the record.
Article 10 If a member violates the Constitution of the Association or violates the criminal law, the Association may decide to suspend or cancel his membership.
Article 11 Members of local industry and commerce federations at various levels shall also be members of higher industry and commerce federations.
Article 12 Members of the Association have the following rights:

Article 15 The federation of industry and commerce may set up trade associations or trade chambers and other trade organizations according to the trade, and the federation of industry and commerce at the same level shall be its competent unit.
Article 16 The organizing principles of this Association are Democratic centralism . The federation of industry and commerce at higher levels has a guiding relationship with the federation of industry and commerce at lower levels.
Article 17 The highest organ of power of the federation of industry and commerce at all levels shall be the member congresses or member assemblies at all levels. Its mandate is to:

Article 18 The congress of members of the federation of industry and commerce at all levels or the general assembly of members shall be convened once every five years. It may be convened earlier or later if necessary.
Members' congresses or general meetings at all levels are convened by the Executive Committee. An elected bureau presides during the session.
Article 19 Delegates to the member congresses of industry and commerce federations at various levels shall be elected through consultation and may, when necessary, also invite some delegates.
The number of delegates to the members' congress and the method of allocation shall be decided by the Executive Committee or the authorized Standing Committee.
Article 20 The executive committee of the federation of industry and commerce at all levels shall be the highest leading organ of the federation of industry and commerce at all levels when the congress of members is not in session. Its functions and powers are as follows:
(1) implementing the resolutions of the members' Congress or the members' Congress;
(2) To hear and examine the reports of the Standing Committee;

Article 22 The Standing Committee shall be composed of the Chairman, Vice-Chairman and Standing members for the same term as the Executive Committee, and shall exercise the functions and powers of the Executive Committee when the Executive Committee is not in session:
(1) implementing the resolutions of the Executive Committee;
(2) Discuss and study the policies and tasks of the Association;
(3) Be responsible for and report on the work of the Executive Committee.
The Standing Committee meets twice a year.
The method for the allocation and election of members of the next Standing Committee shall be decided by the previous Executive Committee or the authorized Standing Committee.
The federation of industry and commerce of a county-level city (county, banner, district under the jurisdiction of a city under the jurisdiction of a provincial municipality) shall decide whether to set up a standing committee according to the circumstances.
Article 23 The Chairman shall preside over the business of the meeting, and the Vice-Chairmen shall assist the Chairman in his work. The Chairman and vice chairmen shall form the Chairman's meeting to study and decide on important matters.
The vice-presidents are divided into full-time vice-presidents and part-time vice-presidents. In principle, full-time vice presidents shall serve no more than two consecutive terms. In principle, the part-time vice chairmen of the All-China Federation of Industry and Commerce shall not serve consecutive terms, and the part-time vice chairmen of local industry and commerce federations shall serve no more than two consecutive terms in principle.
The All-China Federation of Industry and Commerce and the federation of industry and commerce of provinces, autonomous regions and municipalities directly under the Central Government may have a first Vice Chairman and an Executive Vice Chairman.
The executive vice chairmen of the Federation of industry and commerce of provinces, autonomous regions and municipalities directly under the Central Government shall be nominated by the Chairman and approved by the Standing Committee. The Executive Vice Chairman shall assist the President in conducting the business of the meeting.
The leading body and leader elected by each Executive Committee shall continue to preside over the regular work during the session of the next Congress of Members or General Assembly until the new leading body and leader are elected by the next Executive Committee.
Article 24 The Secretary-General of a local industry and commerce federation at various levels shall be elected by the executive committee at the same level and shall be a member of the standing Committee and the Chairman's meeting at the same level.
Article 25 The composition of the executive committee and the standing committee of the federation of industry and commerce at various levels may be adjusted in its session. The personnel to be adjusted shall be approved by the Standing Committee and submitted to the Executive Committee for confirmation.
When a local industry and commerce federation at various levels changes its term, it shall report the preparations to the industry and commerce federation at the next higher level, and report the election results to the industry and commerce federation at the next higher level for the record.
Article 26 Industry and commerce federations at all levels shall set up working departments and special committees according to the needs of their work.
Article 27 When a new local industry and commerce federation is established, it shall be submitted to the Party committee at the same level for approval and to the industry and commerce federation at a higher level for the record.
Article 28 All-China Federation of Industry and Commerce, also known as China non-governmental Chamber of Commerce The local Federation of Industry and Commerce is also a local non-governmental chamber of commerce organization.
The president shall serve concurrently as the chairman of the Federation of Industry and Commerce, and the vice President shall, in principle, be the full-time vice chairman of the Federation of Industry and Commerce, some part-time vice chairmen of the federation of Industry and Commerce of the previous term, and qualified representatives of the non-public sector of the economy.
In principle, the non-public economic representatives of the vice chairmen of the Chinese civil chamber of commerce do not serve consecutively, and the vice chairmen of the local non-governmental chamber of commerce shall serve no more than two consecutive terms in principle.

Article 33 These Articles of Association shall be the uniform articles of association of the Federation of Industry and Commerce at all levels (non-governmental chambers of commerce) and shall be adopted by the All-China Federation of Industry and Commerce members' Congress.
