Regulations for the Implementation of the Road Traffic Safety Law of the People's Republic of China
Chapter I General rules
Article 1 These Regulations are formulated in accordance with the provisions of the Road Traffic Safety Law of the People's Republic of China (hereinafter referred to as the Road Traffic Safety Law).
Article 2 Vehicle drivers, pedestrians and passengers as well as units and individuals related to road traffic activities within the territory of the People's Republic of China shall abide by the Road Traffic Safety Law and these Regulations.
Article 3 Above the county level Local people's governments at various levels It shall establish and improve the coordination mechanism of road traffic safety work, organize relevant departments to carry out traffic impact assessment on urban construction projects, formulate road traffic safety management plans, determine management objectives, and formulate implementation plans.
Chapter II Vehicles and Drivers
Section I Motor vehicle
Article 4 Registration of motor vehicles It is divided into registration, change registration, transfer registration, mortgage registration and cancellation registration.
Article 5 Apply for a motor vehicle license plate for the first time. Driving license An application for registration shall be made to the traffic administrative department of the public security organ where the motor vehicle owner resides.
To apply for motor vehicle registration, the motor vehicle shall be submitted for inspection, and the following certificates and vouchers shall be submitted:
(1) the identity certificate of the motor vehicle owner;
(2) Purchase invoice and other motor vehicle origin certificate;
(3) the certificate of the vehicle leaving the factory or the import certificate of the imported motor vehicle;
(4) Vehicle purchase tax payment certificate or exemption certificate;
(5) motor vehicle third party liability compulsory insurance certificate;
(6) Other certificates and vouchers required by laws and administrative regulations to be submitted at the time of motor vehicle registration. If the vehicle type is not exempt from safety technical inspection as prescribed by the competent department of motor vehicle products under The State Council, the certificate of passing the safety technical inspection of motor vehicle shall also be provided.
Article 6 Where a registered motor vehicle has one of the following circumstances, the owner of the motor vehicle shall apply to the traffic management department of the public security organ that registered the motor vehicle for alteration registration:
(1) changing the color of the vehicle body;
(2) replacing the engine;
(3) replacing the body or frame of the vehicle;
(4) Because of quality problems, the manufacturer replaced the whole vehicle;
(5) The operation of motor vehicles is changed Non-operational motor vehicle Or the non-operating motor vehicle is changed to the operating motor vehicle;
(6) The domicile of the motor vehicle owner is moved out of or into the area under the jurisdiction of the traffic administrative department of the public security organ. To apply for registration of alteration of a motor vehicle, the following certificates and vouchers shall be submitted, and if they fall under any of the circumstances of items (1), (2), (3), (4) or (5) of the preceding paragraph, the motor vehicle shall also be submitted for inspection; In the case of items (2) and (3) of the preceding paragraph, the motor vehicle safety technical inspection certificate shall be submitted at the same time:

Article 7 Where the ownership of a registered motor vehicle is transferred, the transfer registration shall be handled in a timely manner.

(1) identity certificate of the party concerned;
(2) Certificates and vouchers for the transfer of ownership of motor vehicles;
(3) motor vehicle registration certificate;
Article 8 Where the motor vehicle owner uses the motor vehicle as collateral, the motor vehicle owner shall apply for mortgage registration with the traffic administrative department of the public security organ that registered the motor vehicle.
Article 9 Where the registered motor vehicle reaches the compulsory scrapping standard stipulated by the State, the traffic management department of the public security organ shall notify the motor vehicle owner to cancel the registration two months before the scrapping period expires. The motor vehicle owner shall sell the motor vehicle to the motor vehicle recycling enterprise before the expiration of the scrapping period, and the motor vehicle recycling enterprise shall submit the scrapped motor vehicle registration certificate, number plate and driving license to the traffic management department of the public security organ for cancellation. If the motor vehicle owner fails to cancel the registration within the time limit, the traffic administrative department of the public security organ shall announce that the motor vehicle registration certificate, number plate and driving permit are invalid.
Where an application is made for cancellation of registration due to the loss of a motor vehicle, the motor vehicle owner shall submit his identity certificate to the traffic administrative department of the public security organ and return the motor vehicle registration certificate.
Article 10 Where the certificates and certificates submitted by the applicant for motor vehicle registration are complete and valid, the traffic administrative department of the public security organ shall go through the registration procedures on the spot.
People's court , People's procuratorate The traffic management department of the public security organ shall not handle the registration of the motor vehicle if the administrative law enforcement department seals up or impounded the motor vehicle according to law.
Article 11 Where a motor vehicle registration certificate, number plate or driving permit is lost or damaged and the motor vehicle owner applies for replacement, he shall submit his identity certificate and application materials to the traffic administrative department of the public security organ. The traffic management department of the public security organ shall, after verification with the motor vehicle registration file, reissue the application within 15 days from the date of receipt.
Article 12 Tax departments and insurance institutions may, in the office of the traffic administrative department of the public security organ, centrally handle matters such as the payment of taxes and fees related to motor vehicles and the conclusion of insurance contracts.
Article 13 The motor vehicle number plate shall be hung in the designated position in front of the vehicle and behind the vehicle to keep it clear and complete. Heavy and medium trucks and their trailers, tractors and their trailers should be painted with enlarged brand numbers on the body or back of the car, and the words should be straight and clear. The motor vehicle inspection mark and insurance mark shall be affixed to the upper right corner of the front window of the motor vehicle. Painting or pasting marks or body advertisements on motor vehicles shall not affect safe driving.
Article 14 Passenger vehicles, heavy trucks and semi-tractor used for highway operation shall be installed and used a driving recorder that meets the national standards. Traffic police can check motor vehicle speed, continuous driving time and other driving status information. Article 15 The motor vehicle safety technical inspection shall be carried out by the motor vehicle safety technical inspection institution. The motor vehicle safety technical inspection institution shall inspect the motor vehicle in accordance with the national motor vehicle safety technical inspection standards, and bear legal responsibility for the test results. Quality and technical supervision The department shall be responsible for the qualification management and measurement certification management of motor vehicle safety technical inspection institutions, the verification of motor vehicle safety technical inspection equipment, and the supervision of the implementation of national motor vehicle safety technical inspection standards. Motor vehicle safety technical inspection items shall be formulated by the public security department under The State Council jointly with the quality and technical supervision department under The State Council.
Article 16 A motor vehicle shall, from the date of registration, undergo safety technical inspection in accordance with the following deadlines:
(A) the operation of passenger vehicles within 5 years once a year inspection; More than 5 years, once every 6 months inspection;
(2) Inspection of trucks and large and medium-sized non-operating passenger vehicles once a year within 10 years; More than 10 years, once every 6 months inspection;
(3) Small and micro non-operating passenger vehicles shall be inspected once every two years within 6 years; More than 6 years, once a year inspection; More than 15 years, once every 6 months inspection;
(4) The motorcycle shall be inspected once every two years within four years; More than 4 years, once a year inspection;
(5) Tractors and other motor vehicles shall be inspected once a year. If the motor vehicle in operation passes the safety technical inspection within the prescribed inspection period, the safety technical inspection shall not be repeated.
Article 17 When a registered motor vehicle is undergoing safety technical inspection, where the registration content recorded in the driving license of the motor vehicle is inconsistent with the relevant conditions of the motor vehicle, or the certificate of compulsory third party liability insurance of the motor vehicle is not provided in accordance with the provisions, it shall not pass the inspection.
Article 18 The public security department under The State Council shall formulate regulations on the spraying of logo patterns of police cars, fire engines, ambulances and engineering rescue vehicles, as well as the installation and use of alarms and sign lamps.
The second section Motor vehicle driver
Article 19 A person who meets the requirements for a driving license prescribed by the public security department under The State Council may apply to the traffic administrative department of the public security organ Motor vehicle driving license .
The public security department under The State Council shall prescribe the form of a motor vehicle driving license and supervise its preparation.
Article 20 To learn motor vehicle driving, shall first learn road traffic safety laws, regulations and related knowledge, and then learn motor vehicle driving skills after passing the examination.
Learning to drive on the road shall be conducted in accordance with the route and time designated by the traffic administrative department of the public security organ. Learning motor vehicle driving skills on the road shall use the coach, under the guidance of the coach, and no person unrelated to teaching shall ride the coach. If a student commits an illegal act of road traffic safety or causes a traffic accident while learning to drive, the instructor shall bear the responsibility.
Article 21 The traffic administrative department of the public security organ shall conduct an examination on the applicant for a motor vehicle driving license, and issue a motor vehicle driving license to the applicant who passes the examination within 5 days; For those who fail the examination, give reasons in writing.
Article 22 The validity period of a motor vehicle driving license shall be 6 years, except as otherwise provided for in these Regulations.
The internship period shall be 12 months after a motor vehicle driver first applies for a motor vehicle driving license. Anyone who drives a motor vehicle during the internship period shall paste or hang a uniform style internship sign at the rear of the vehicle body.
During the internship period, a motor vehicle driver shall not drive a bus, a passenger car for operation, a police car, a fire engine, an ambulance, an engineering rescue vehicle, or a motor vehicle carrying explosive substances, inflammable and explosive chemicals, highly toxic or radioactive substances and other dangerous substances; The motor vehicle driving may not pull the trailer.
Article 23 The traffic administrative department of the public security organ shall, in addition to imposing administrative penalties on the road traffic safety violations of the motor vehicle drivers, implement the cumulative demerit points system for road traffic safety violations (hereinafter referred to as demerit points), and the demerit period is 12 months. If the score reaches 12 points in a scoring cycle, the traffic administrative department of the public security organ shall detain his motor vehicle driving license, and the motor vehicle driver shall participate in the study of road traffic safety laws and regulations and accept the examination in accordance with the provisions. Those who pass the examination shall have their points scored and their motor vehicle driving licenses returned; Those who fail the examination shall continue to take part in the study and examination. The road traffic safety violations that should be given points and their scores shall be prescribed by the public security department under The State Council according to the degree of harm caused by the road traffic safety violations. The traffic administrative department of the public security organ shall provide the scoring inquiry method for the motor vehicle driver to inquire.
Article 24 Where the demerit points of a motor vehicle driver do not reach 12 points within a demerit period and the fine imposed has been paid, the demerit points shall be eliminated; If the score does not reach 12 points, but there is still a fine unpaid, the score will be transferred to the next score cycle. A motor vehicle driver who scores more than 12 points twice in a demerit cycle shall, in addition to detaining his motor vehicle driving license, participating in studies and accepting examinations in accordance with the provisions of Article 23, also accept the driving skills examination. Those who pass the examination shall have their points scored and their motor vehicle driving licenses returned; Those who fail the examination shall continue to take part in the study and examination. To accept the driving skills test, in accordance with the motor vehicle driving license of the highest permitted driving test.
Article 25 Where a motor vehicle driver has scored 12 points and refuses to participate in the study notified by the traffic administrative department of the public security organ or accept the examination, the traffic administrative department of the public security organ shall announce the suspension of the use of his motor vehicle driving license.
Article 26 If a motor vehicle driver fails to score 12 points per demerit period within the 6-year validity period of his motor vehicle driving license, a motor vehicle driving license valid for 10 years shall be renewed; Within the 10-year validity period of the motor vehicle driving license, if each demerit period does not reach 12 points, a long-term valid motor vehicle driving license shall be renewed.
When renewing a motor vehicle driving license, the traffic administrative department of the public security organ shall examine the motor vehicle driving license.
Article 27 Where a motor vehicle driving license is lost or damaged and a motor vehicle driver applies for replacement, he shall submit his identity certificate and application materials to the traffic administrative department of the public security organ. The traffic administrative department of the public security organ shall, after verification with the motor vehicle driving license file, reissue it within 3 days from the date of receipt of the application.
Article 28 A motor vehicle driver may not drive a motor vehicle if his motor vehicle driving license is lost, damaged, has exceeded its validity period, or has been detained or temporarily detained according to law, and the number of points scored has reached 12.
Chapter III Road conditions
Article 29 Traffic lights are divided into: motor vehicle traffic lights, non-motor vehicle traffic lights, pedestrian crossing traffic lights, lane traffic lights, direction indicating traffic lights, flashing warning traffic lights, road and railway level crossing traffic lights.
Article 30 Traffic signs are divided into: indicating signs, warning signs, prohibition signs, road directions signs, tourist area signs, road construction safety signs and Auxiliary mark .

Article 31 Traffic police command is divided into hand signals and traffic command signals for the use of equipment.
Article 32 Pedestrian crosswalks, street overpasses or street underpasses shall be provided on sections where road intersections and pedestrian crossings are relatively concentrated.

Article 33 The relevant departments of the people's governments of cities may, on the condition that the passage of pedestrians and vehicles is not affected, designate parking berths on urban roads and prescribe the use time of parking berths.
Article 34 The opening or adjustment of bus and long-distance bus routes or stations shall conform to traffic planning and the requirements for safety and smooth flow.
Article 35 Road maintenance construction units shall set up standardized safety warning signs and safety protection facilities in accordance with regulations when carrying out maintenance and repair on roads. Road maintenance construction vehicles, machinery should be installed with warning lights, spraying obvious logo patterns, operation should be turned on enlightening warning lights and Hazard warning flash . For construction roads that do not interrupt traffic, the traffic administrative department of the public security organ shall strengthen traffic safety supervision and inspection. Road construction requires vehicles to detour, the construction unit shall set up signs at the detour; Where detour is not possible, temporary passages shall be built to ensure the passage of vehicles and pedestrians. Article 36 The maintenance and administrative departments of road or traffic facilities shall set up warning signs and safety protection facilities in accordance with the national standards on dangerous road sections such as sharp bends, steep slopes, cliff faces and water faces.
Article 37 Road traffic sign If the marking is not standardized and the motor vehicle driver is prone to misidentification, the competent department of traffic signs and marking shall make timely improvements. Section I General provisions
Article 38 Motor vehicle signal lights and non-motor vehicle signal lights indicate:

(2) When the yellow light is on, vehicles that have crossed the stop line may continue to pass;

At intersections where there is no non-motor vehicle signal light and pedestrian crosswalk signal light, non-motor vehicles and pedestrians shall pass according to the motor vehicle signal light. When the red light is on, vehicles turning right may pass without obstructing the passage of vehicles and pedestrians being released.

Section 2 Provisions on the passage of motor vehicles
Article 44 Where there are two or more motor vehicle lanes in the same direction of a road, the left side is the fast lane and the right side is the slow lane. A motor vehicle running in the express lane shall run at the speed specified in the express lane; if it fails to reach the speed specified in the express lane, it shall run in the slow lane. Motorcycles should stay in the far right lane. If there is a traffic sign indicating the driving speed, it shall drive according to the indicated driving speed. When a motor vehicle in the slow lane overtakes the vehicle in front, it can use the fast lane to drive. Where there are two or more motor vehicle lanes in the same direction of the road, the motor vehicle changing the lane shall not affect the normal running of the motor vehicle running in the relevant lane.
Article 45 A motor vehicle may not run on a road in excess of the speed indicated on the speed limit sign or line marking. On a road without speed limit signs or markings, a motor vehicle may not exceed the following maximum speed:
(a) roads without a road centerline, 30 km/h for urban roads and 40 km/h for highways;
(2) Roads with only one motor vehicle lane in the same direction, 50 km/h for urban roads and 70 km/h for highways.
Article 46 In any of the following cases, the maximum speed of a motor vehicle shall not exceed 30 kilometers per hour, including tractors, electric vehicles, Wheeled special mechanical vehicle Not exceeding 15 km/h:

Article 47 When a motor vehicle overtakes another vehicle, it shall turn on the left turn signal in advance, change the use of far or low light lights or sound the horn. On a road where there is no road center line or only one motor vehicle lane in the same direction, when the front vehicle meets the rear vehicle and sends an overtaking signal, if conditions permit, it shall reduce its speed and give way to the right. Article 48 On a road without a central isolation facility or a Central Line, a motor vehicle shall comply with the following provisions when encountering a vehicle coming in the opposite direction:
(a) slow down and drive to the right, and maintain the necessary safety distance from other vehicles and pedestrians;

Article 49 A motor vehicle may not make a U-turn at a place marked with signs prohibiting U-turn or a left turn, or at a railway crossing, pedestrian crossing, bridge, sharp bend, steep slope, tunnel or a road section prone to danger. A motor vehicle may make a U-turn at a place where there is no sign or line marking prohibiting a U-turn or a left turn, provided that the passage of other vehicles and pedestrians running normally is not obstructed.
Article 50 When reversing a motor vehicle, it shall investigate the situation behind the vehicle and reverse after confirming safety. It is not allowed to reverse at railway crossings, intersections, one-way roads, Bridges, sharp bends, steep slopes or tunnels.
Article 51 A motor vehicle passing through an intersection controlled by a traffic signal lamp shall pass in accordance with the following provisions:
(1) At an intersection marked with a guide lane, enter the guide lane in the required direction;
(b) ready to enter the roundabout to let the motor vehicles already in the intersection first;

Article 59 When a motor vehicle passes a sharp turn, slope, arch bridge, pedestrian crossing or an intersection without traffic signal control at night, it shall alternately use a light signal. Article 61 A motor vehicle with traction failure shall comply with the following provisions:

Article 63 A motor vehicle temporarily parking on a road shall comply with the following provisions:

Article 87 Where a traffic accident between a non-motor vehicle and a non-motor vehicle or a pedestrian on a road does not cause personal injury or death, and the basic facts and causes of the accident are clear, the parties shall first withdraw from the scene and then negotiate matters of compensation for damage on their own. If the parties have disputes over the facts and causes of the traffic accident, they shall promptly report to the police.
Article 88 Where a motor vehicle has a traffic accident, resulting in damage to roads, power supply, communications and other facilities, the driver shall report to the police and wait for treatment, and shall not leave. If a motor vehicle can be moved, it shall be moved to a place that does not impede traffic. The traffic administrative department of the public security organ shall notify the relevant departments of the accident.
Article 89 The traffic administrative department of the public security organ or the traffic police shall rush to the scene in a timely manner after receiving a traffic accident alarm. If no personal injury or death has been caused, the facts are clear, and the motor vehicle can be moved, the party concerned shall be ordered to withdraw from the scene and resume traffic after recording the accident situation. Article 90 Where a motor vehicle insured with compulsory third party liability insurance has a traffic accident and the rescue expenses of the insurance company are required to be paid by the insurance company due to the rescue of the injured person, the traffic administrative department of the public security organ shall notify the insurance company. If the road traffic accident rescue fund is required to pay the expenses in advance, the traffic administrative department of the public security organ shall notify the administrative institution of the road traffic accident social rescue fund.
Article 91 The traffic administrative department of the public security organ shall determine the liability of the parties to the traffic accident on the basis of the role of the parties' behavior in the occurrence of the traffic accident and the severity of the fault.
Article 92 Where a party flees after a traffic accident occurs, the party who flees shall bear full responsibility. However, if there is evidence that the other party is also at fault, liability may be reduced. If a party intentionally destroys or falsifies the scene or destroys evidence, he shall bear full responsibility.
Article 93 The traffic administrative department of the public security organ shall, within 10 days from the date of the investigation of the traffic accident that has been investigated and inspected at the scene, make a production Traffic accident confirmation letter . Article 95 The time limit for mediation of disputes over compensation for damage caused by traffic accidents by the traffic administrative department of the public security organ is 10 days. Where an agreement is reached through mediation, the traffic administrative department of the public security organ shall prepare a mediation statement and send it to the parties concerned. The mediation statement shall take effect after being jointly signed by the parties concerned. If no agreement is reached in mediation, the traffic management department of the public security organ shall prepare a mediation termination letter and send it to the parties. Traffic accident damage compensation items and standards shall be implemented in accordance with the provisions of relevant laws.
Article 96 Where a party to a dispute over compensation for damage caused by a traffic accident files a civil suit with a people's court, the traffic administrative department of the public security organ shall no longer accept an application for mediation.
During the period of mediation by the traffic administrative department of the public security organ, if the parties file a civil suit in the people's court, the mediation shall terminate.
Article 97 Where a traffic accident occurs outside the road and the traffic administrative department of the public security organ receives a report, it shall be handled with reference to the Road Traffic Safety Law and the provisions of these Regulations.
Traffic accidents involving vehicles, pedestrians and trains, as well as traffic accidents at ferries, shall be dealt with in accordance with the relevant provisions of the State.
Chapter VI Supervision of Law enforcement
Article 98 The traffic management department of the public security organ shall make public its working system and procedures, establish a system of police discipline supervisors, and consciously accept the supervision of the society and the masses.
Article 99 The traffic administrative department of the public security organ and its traffic police shall strictly abide by the relevant provisions in handling the registration of motor vehicles, issuing license plates, examining and issuing licenses to drivers, dealing with illegal acts of road traffic safety and dealing with road traffic accidents, and shall not exceed the power of law enforcement, shall not delay the performance of their duties, and shall not change the types and ranges of penalties without authorization.

Chapter VII Legal liability
Article 102 Any act violating the provisions of these Regulations shall be punished in accordance with the Road Traffic Safety Law and the provisions of these Regulations.
Article 103 Where a motor vehicle registration or driving permit is obtained by cheating, bribery or other improper means, the motor vehicle registration certificate, number plate, driving certificate or motor vehicle driving license shall be confiscated, and the motor vehicle registration or motor vehicle driving license shall be revoked; The applicant shall not apply for motor vehicle registration or motor vehicle driving permit within 3 years.
Article 104 Where a motor vehicle driver commits any of the following acts and no other motor vehicle driver immediately substitutes for driving, the traffic administrative department of the public security organ may, in addition to imposing penalties according to law, move the motor vehicle driven by him to a place that does not impede traffic or a place designated by the relevant department:
(1) Unable to produce his valid driving license;
(2) the motor vehicle driving does not conform to the type of permitted driving listed in the driving license;
(3) drinking alcohol, taking psychotropic substances or narcotic drugs under state control, suffering from diseases that hinder safe driving, or continuing to drive despite excessive fatigue;
(4) The learner driver drives alone without the guidance of an instructor.
Article 105 A motor vehicle driver who is suspected of drinking alcohol, being drunk or taking psychotropic drugs or narcotic drugs under state control shall be tested and examined.
Article 106 Where a highway passenger vehicle has more than the authorized occupants or a cargo vehicle has more than the authorized load, after the traffic administrative department of the public security organ has detained the motor vehicle according to law, the driver shall transfer the overloaded passenger or unload the overloaded cargo, and the expenses shall be borne by the driver or the owner of the overloaded motor vehicle.
