The Standing Committee of the National People's Congress, referred to as the Standing Committee of the National People's Congress, is the highest organ of state power in the People's Republic of China

A number of people. The members of the Standing Committee shall be elected by the National People's Congress from among the deputies. No member of the Standing Committee shall hold any post in any administrative, supervisory, judicial or procuratorial organ of the State. If he/she holds any of the above posts, he/she shall resign from the Standing Committee.

The Standing Committee shall establish a representative qualification examination committee. The Standing Committee shall establish the Commission for Legislative Affairs, the Commission for Budget Affairs and other working committees as required. The Standing Committee must submit a report on its work to the National People's Congress at each session of the Congress.

The Chairman's Council, the special committees of the National People's Congress, The State Council, the Central Military Commission, the State Supervisory Commission, the Supreme People's Court, the Supreme People's Procuratorate, and ten or more members of the Standing Committee may jointly submit to the Standing Committee bills and proposals that fall within the scope of its functions and powers.
During the session of the Standing Committee, ten or more members of the Standing Committee may jointly submit to the Standing Committee written questions addressed to The State Council, the departments under The State Council, the National Supervisory Commission, the Supreme People's Court and the Supreme People's Procuratorate.
When the National People's Congress is not in session, the Standing Committee may, upon nomination by the Premier of The State Council, decide on the appointment or removal of other members of The State Council; Upon nomination by the Chairman of the Central Military Commission, the appointment or removal of other members of the Central Military Commission may be decided.
When the National People's Congress is not in session, the Standing Committee may, at the request of the Chairman's Council or the Premier of The State Council, decide to remove other individual members of The State Council from their posts; At the request of the Chairman of the Central Military Commission, a decision may be made to remove other individual members of the Central Military Commission.
The Standing Committee must submit a report on its work to the National People's Congress at each session of the Congress.

General office
The Standing Committee shall establish a general office and work under the leadership of the Secretary-General.
The Standing Committee shall have a number of deputy Secretary-General, who shall be appointed or removed by the Standing Committee upon the recommendation of the Chairman of the Standing Committee.
Representative qualification Committee
The Standing Committee shall establish a representative qualification examination committee.
Candidates for the Chairman, vice-chairmen and members of the credentials Committee shall be nominated by the Chairman's Council from among the members of the Standing Committee, and appointed or removed by the Standing Committee.

Working committee
The Standing Committee shall establish the Commission for Legislative Affairs, the Commission for Budget Affairs and other working committees as required.
The Chairman, vice-chairmen and members of the working committee shall be appointed or removed by the Standing Committee upon proposal by the Chairman of the Standing Committee.
The establishment, functions and appointment or removal of members of the Commission for the Basic Law of the Hong Kong Special Administrative Region of the NPC Standing Committee and the Commission for the Basic Law of the Macao Special Administrative Region of the NPC Standing Committee shall be governed by relevant laws and relevant decisions of the National People's Congress.

Delegate working committee
In June 2023, the NPC Standing Committee was established.
It is the working body of the Standing Committee of the National People's Congress.

The members of the Standing Committee shall be elected by the National People's Congress from among the deputies. No member of the Standing Committee shall hold any post in any administrative, supervisory, judicial or procuratorial organ of the State. If he/she holds any of the above posts, he/she shall resign from the Standing Committee.
The Chairman of the Standing Committee presides over the meetings and work of the Standing Committee. The Vice Chairmen and the Secretary-General assist the Chairman in his work. Entrusted by the Chairman, the vice Chairman may assume some of the functions and powers of the Chairman.
In the event that the Chairman is incapacitated for work due to ill health or becomes vacant, the Standing Committee shall elect one of the Vice-chairmen to act as Chairman until the Chairman recovers his health or the National People's Congress elects a new Chairman.
The Chairman, Vice-Chairmen and Secretary-General of the Standing Committee constitute the Council of Chairmen, which deals with the important daily work of the Standing Committee:
(1) To decide on the duration of each meeting of the Standing Committee, to draw up the draft agenda of the meeting and, if necessary, to make suggestions for adjusting the agenda of the meeting;
(2) To decide to refer the bills and questions submitted to the Standing Committee to the relevant special committee for deliberation or to the plenary session of the Standing Committee for deliberation;
(3) To decide whether to submit a motion, draft decision or draft resolution to the plenary meeting of the Standing Committee for a vote, and to put forward opinions on the next step if it is not put to a vote temporarily;
(4) To adopt the Standing Committee's annual work points, legislative work plans, supervision work plans, representative work plans, special work plans and work normative documents;
(5) To guide and coordinate the daily work of the special committees;
(6) To handle other important daily work of the Standing Committee.
