Jilin Provincial Department of Commerce government information disclosure guide

   In order to facilitate citizens, legal persons and other organizations to obtain government information, in accordance with the Regulations of the People's Republic of China on the Disclosure of Government Information (hereinafter referred to as the Regulations), the Guidelines for the Disclosure of Government Information of the Department of Commerce of Jilin Province (hereinafter referred to as the Guidelines) are formulated. The government information in the possession of this organ shall be made public or provided upon application by citizens, legal persons and other organizations, except those which are exempted from disclosure according to law, and those related to economic and social management and public services. The disclosure of government information by this organ shall follow the principles of justice, fairness and convenience to the people. Citizens, legal persons and other organizations in need of information disclosure services of the authorities are advised to read this Guide.
   The Guide is updated once a year and can be accessed by citizens, legal persons and other organizations on the portal website of Jilin Provincial People's Government (www.jl.gov.cn) under the column "Government Information Disclosure" or on the website of their own units, or on-site at the Provincial Government Open Information Access and Utilization Center (Jilin Provincial Archives, No. 63 Min 'an Road, Nanguan District, Changchun City).
First, actively disclose information
(1) The scope of disclosure
   The scope of information voluntarily disclosed to the public free of charge by this organ is referred to the Catalogue of Government Information Disclosure of the Department of Commerce of Jilin Province compiled by this organ.
(2) The form of disclosure
   For the active disclosure of information, this organ mainly adopts two forms of online disclosure and provincial government open information access and utilization center. (3) Time limit for disclosure
   The time limit for the disclosure of information by this authority shall be 20 working days from the date on which the information is formed or produced.
2. Disclosure of information upon application
(1) The scope of disclosure
   In addition to the government information voluntarily disclosed by the government organ, citizens, legal persons or other organizations may apply to the government organ for obtaining relevant government information.

(3) The filing of an application
   To apply to this organ, fill in the Jilin Provincial Government Information Disclosure Application Form (hereinafter referred to as the Application Form). The copy of this form is valid and can be obtained at the acceptance organ, or the electronic version can be downloaded on the website of the unit.
   In order to improve the efficiency of processing the application, the applicant should describe the required information as detailed and clear as possible, and if possible, provide the title of the information, the time of publication, the symbol number or other tips to help the authority determine the carrier of the information.
   1, letter, telegram, fax application. If the applicant makes the application by letter, the recipient shall fill in the competent government information disclosure authority of XX government or the competent government information disclosure authority of XX working department, please indicate the words "Application for government information disclosure" in the lower left corner of the envelope; If the applicant applies by telegram or fax, please indicate the words "Application for disclosure of government information" in the corresponding position. To apply for government information disclosure, please fill in the Application Form for Government Information Disclosure.
   2. Apply in person. The applicant may submit an application on the spot with a valid identity document.
   3. Special procedures. Where an applicant applies for access to government information related to himself or herself, he or she shall present a valid identity document and submit a written application to this authority in person.
   The agency does not directly accept applications made by telephone, but the applicant can consult the corresponding service business by telephone.
(4) Acceptance of applications
   After receiving an application submitted by a citizen, legal person or other organization, the organ shall check the identity of the applicant, examine whether the elements of the application are complete in a formal manner, and return the application with incomplete elements and require the applicant to make corrections.
   If the information to be obtained belongs to the information that has been voluntarily disclosed by the authority, the authority shall suspend the procedure of accepting the application and inform the applicant of the ways and means of obtaining the information.
   The agency handles applications according to the order in which they are received. If several independent requests are made in a single application at the same time, the agency will reply uniformly after all processing is completed. In view of the possibility of different responses to different requests, applicants are advised to apply separately for different requests in order to enhance processing efficiency.
   The time limit for accepting a single application shall not exceed 20 working days from the date of registration. The specific reply method shall be as follows:
   (1) If it belongs to the scope of publicity, inform the applicant of the ways and means by which the government information can be obtained; Or reply directly to the disclosure content of the application.
   (2) If it is exempt from disclosure, inform the applicant of the reasons for not making it public;
   (3) If it does not belong to the scope of disclosure of this authority, inform the applicant of the authority and contact information of the information;
   4. If the government information applied for disclosure does not exist, inform the applicant. The information provided by the agency in accordance with the application will not be charged. However, if the number and frequency of the applicant's application for disclosure of government information obviously exceeds the reasonable range, this organ may collect an information processing fee, and the specific measures for collecting the information processing fee shall be formulated by the price department under The State Council in conjunction with the financial department under The State Council and the competent department of government information disclosure throughout the country.
In addition, administrative agencies provide government information on request without charge. However, if the number and frequency of the applicant's application for disclosure of government information obviously exceeds the reasonable range, the administrative organ will charge an information processing fee. The collection of information processing fees by administrative organs shall be carried out in accordance with the principles and standards set out in the Notice of The General Office of the State Council on the Issuance of the Administrative Measures for the Administration of Information Processing Fees for Government Information Disclosure (State Office Letter (2020) No. 109).
3. Supervision methods and procedures  
   Citizens, legal persons or other organizations that believe that their organs have failed to fulfill the obligations of government information disclosure in accordance with the law may complain to the supervisory departments.
In addition, citizens, legal persons or other organizations can also report to the supervisory authority or resolve the matter through legal means.
