I. Brief description
Any natural person, legal person or other organization that needs to obtain the exclusive right to use a trademark for the goods or services it produces, manufactures, processes, selects or distributes shall file an application for trademark registration with the Trademark Office of the State Administration for Industry and Commerce (hereinafter referred to as the Trademark Office) in accordance with law. The International Classification of Goods and Services for trademark registration has 45 categories, of which 34 are goods and 11 are services. A trademark designated for use on goods is a trademark of goods, and a trademark designated for use on services is a service trademark. 2. Preparation of trademark registration application
(1) To apply for trademark registration in the name of a legal person or other organization, the following application forms shall be submitted: 1. Application for trademark registration with the official seal of the applicant. 2, trademark pattern 6 (application on the back of 1, 5), the requirements of the pattern is clear, the length and width of the specification is not less than 5 cm and not more than 10 cm. If the color is specified, attach 1 pattern, hand in 5 patterns, and attach 1 black and white pattern. 3, directly to the trademark registration hall for processing, submit a copy of the applicant's business license, and show the original copy of the business license; If the original copy of the business license cannot be produced, the copy of the applicant's business license shall be stamped with the applicant's seal. If a trademark agency is entrusted to handle the matter, a copy of the applicant's business license shall be submitted. 4, directly to the trademark registration hall, submit a copy of the identity card of the operator; Where a trademark agency is entrusted to handle the matter, a power of attorney for trademark agency shall be submitted. 5, if the trademark applied for registration is a portrait, should be attached to the notarized portrait right owner agrees to register this portrait as a trademark statement.
(2) A natural person applying for trademark registration shall submit the following application form: 1, trademark registration application signed by the applicant. 2, trademark pattern 6 (application on the back of 1, 5), the requirements of the pattern is clear, the length and width of the specification is not less than 5 cm and not more than 10 cm. If the color is specified, attach one pattern, hand in five patterns, and attach one black and white pattern. 3, directly to the trademark registration hall, submit a copy of the applicant's ID card or passport, the agent to show the original ID card or passport, submit a copy; If a trademark agency is entrusted to handle the matter, the trademark agency letter and a copy of the applicant's ID card shall be submitted. 4, natural persons applying for trademark registration, should pay attention to the following matters: (1) individual industrial and commercial businesses can be registered in the name of the individual industrial and commercial business license as the name of the applicant to apply for trademark registration, can also be registered in the name of the person in charge of the license to apply for trademark registration. When applying in the name of the person in charge, copies of the following materials shall be submitted: ① ID card of the person in charge; ② Business license. (2) A rural contractor may apply for trademark registration in the name of the contract signer, and copies of the following materials shall be submitted when applying: ① the signer's ID card; ② Contract. (3) Other natural persons permitted to engage in business activities according to law may apply for trademark registration in the name of the business operator listed in the registration documents issued by the relevant administrative authorities, and copies of the following materials shall be submitted when applying: (1) the ID card of the business operator; (2) Registration documents issued by relevant administrative authorities. (4) The scope of goods and services for which natural persons apply for trademark registration shall be limited to the business scope approved by them in the business license or relevant registration documents, or to their own agricultural and sideline products. (5) For trademark registration applications that do not comply with the provisions of Article 4 of the Trademark Law, the Trademark Office will not accept and notify the applicant in writing. Where the applicant provides false materials to obtain a trademark registration, the Trademark Office shall cancel the registered trademark. 5, if the trademark applied for registration is a portrait, should be attached to the notarized portrait right owner agrees to register this portrait as a trademark statement.
