How to register the pledge of trademark exclusive right

I. Brief description
Where the right to exclusive use of a registered trademark is used as a pledge, the pledgor and the pledgee shall conclude a written contract for the pledge of exclusive use of the trademark. After the conclusion of the pledge contract, both the pledgee and the pledgee shall go through the registration formalities for the pledge of the exclusive right to use the trademark at the Renewal Office of the Trademark Office, and both parties may also entrust the trademark agency recognized by the State to handle the registration formalities for the pledge of the exclusive right to use the trademark.
The pledge contract for the exclusive right to use a trademark shall take effect as of the date of registration.
 
2. Preparation of the application form
(1) The application form to be submitted
1. Application for registration of pledge of trademark exclusive right (multiple registration numbers that need to be pledged can be specified in one application);
2, the pledgor and pledgee's business license copy (subject to annual inspection valid);
3. A copy of the Trademark Registration Certificate. If the registrant changes, a copy of the relevant certificate should also be attached;
4. The original or notarized copy of the trademark right pledge contract and the main contract (if the contract is signed by the person authorized by the legal representative, the relevant authorization documents should also be attached);
5. Trademark evaluation report issued by an evaluation agency with intangible assets evaluation qualifications;
6, directly to the trademark office, submit a copy of the identity card and the letter of authorization; If a trademark agency is entrusted to handle the matter, the trademark agency power of attorney issued by both parties shall be submitted.
 
(2) Specific requirements
1, in accordance with the requirements of the application form one by one, and must be printed or printed form.
2. The application for registration of the pledge of trademark exclusive right shall be stamped with the seals of the pledgee and the pledgee, or with the signature of the pledgee and the pledgee, or with the seal of the agent if the agent is entrusted.
3. The trademark right pledge contract shall include the following contents:
(1) The name (name), address and contact information of the pledgor and the pledgee
(2) The reason for the pledge and the type and amount of the principal creditor's right guaranteed;
(3) the term of the pledged trademark and the pledge;
(4) the pledge value and appraisal value of the trademark exclusive right;
(5) Other matters related to the pledged trademark as agreed by the parties.
 
3. Receipt of Registration Certificate of Pledge of Trademark Exclusive Right
Where the application for registration is complete and the application procedures comply with the provisions, the Trademark Office shall register it within 5 working days from the date of acceptance, and issue a Registration Certificate for the Pledge of the Exclusive Right to Use the Trademark. The Registration Certificate of Pledge of Trademark exclusive right can be obtained directly at the renewal Office of Trademark Office, or can be mailed. If it is collected directly, it shall be collected by the person handling the pledge registration or the person authorized by him, and the witness shall bring his own ID card and relevant authorization documents.
If the trademark agency is entrusted to handle, the Trademark Office will send the "Trademark right Pledge Registration Certificate" by mail or to the trademark agency.
 
4. Precautions
1. The address, postal code and telephone number filled in by the applicant should be detailed and accurate to ensure mail delivery and easy contact.
(2) If the trademark applied for pledge has been sealed by the court, or the trademark applied for pledge has been applied for cancellation, the Trademark Office will not accept the pledge application.
(3) The pledge period shall not exceed the term of the exclusive right of the pledged trademark. If multiple trademarks are pledged, the pledge period shall not exceed the term of the exclusive right of the trademark whose exclusive right expires first.
4, the application is returned for correction, the applicant should be corrected in accordance with the provisions of the correction notice, and the original application after correction returned or mailed to the Trademark Office
(5) If the pledgor is not the legal owner of the exclusive right to use the trademark, or the ownership of the exclusive right to use the trademark is not clear, the Trademark Office will not accept it.
6. The pledgor shall apply for pledge of the same or similar trademarks registered on the same or similar goods.
