Steps for filing application for customs protection of intellectual property rights
(1) Register as a system user.
In order to reduce the application time of intellectual property rights holders and improve the efficiency of the General Administration of Customs in reviewing and filing applications, the current application for the Customs protection of intellectual property shall be submitted through the "Intellectual Property Customs Protection Filing Application System", except in special circumstances. Therefore, the filing applicant must first register as a system user before submitting the filing application. The system user shall register in the name of the intellectual property right holder and fill in the necessary user information to obtain the system account number and password;
(2) Input the filing application data.
After the registered user logs in the filing application system, fill in the application for new filing window of intellectual property rights and other related information;
(3) Pay the filing fee.
The filing fee (800 yuan for each filing) shall be remitted to the account of the General Administration of Customs by bank transfer or telegraphic transfer. The authorization number or filing application number must be indicated in the remarks column when the remittance is made.
(4) Submit a paper application.
Print the recorded application data into a paper application with the applicant's or agent's seal, together with a copy of the filing fee payment voucher and other relevant materials
(5) Rectification of the application.
The General Administration of Customs (GAC) will only start the examination after receiving the paper application by post from the applicant. However, the applicant can keep abreast of the entire process of acceptance, review, approval and rejection of the application by the General Administration of Customs through the filing system. The applicant may, in accordance with the opinion of the General Administration of Customs rejecting the application, make a rectification of his application.
(6) Receipt of a notice of approval or rejection of the application.
According to the Regulations on Customs Protection of Intellectual Property Rights, the General Administration of Customs shall make a decision to approve or reject the application within 30 working days from the date of receiving all the application documents submitted by the applicant. When the General Administration of Customs approves or rejects an application for the record, it shall issue a written notice to the applicant. If the General Administration of Customs rejects the application, the original application documents shall not be returned.
