Beijing, Feb. 17 (Xinhua Recently, the General Office of the CPC Central Committee and The General Office of the State Council issued the Opinions on Comprehensively Promoting the openness of government Affairs, and issued a notice requiring all regions and departments to earnestly implement it in light of actual conditions.

The full text of the Opinions on Comprehensively Promoting the openness of government affairs is as follows.

Openness and transparency are the basic characteristics of a law-based government. Promoting openness in government affairs and letting power operate in the light of the sun is of great significance to developing socialist democracy, improving the country's governance capacity, enhancing the government's credibility and executive capacity, and ensuring the people's rights to be informed, to participate, to express their views, and to supervise. The Party Central Committee and The State Council attach great importance to the openness of government affairs and have made a series of major arrangements, which have been earnestly implemented by governments at all levels, and positive results have been achieved in the openness of government affairs. However, compared with the expectations of the people and the requirements of building a government under the rule of law, there are still some problems, such as inadequate concept of openness, imperfect system norms, insufficient efforts in work, and unsatisfactory effectiveness in openness. In order to further improve the work of openness in government affairs at present and in the coming period, the following opinions are put forward.

First, the overall requirements for promoting openness in government affairs

(1) Guiding ideology. With openness as the norm and non-openness as the exception, we will make administrative decisions, implementation, management, services and results more transparent. We will streamline administration, delegate power, strengthen regulation, and improve service reform, stimulate market vitality and social creativity, and build a law-based, innovative, clean and service-oriented government.

(2) Basic principles. Focusing on economic and social development and the concerns and concerns of the people, we will promote implementation through openness, promote norms through openness, and promote services through openness. In accordance with the law and regulations, we will clarify the main body, content, standards, methods, and procedures for making government affairs public, and accelerate the publication of lists of powers, responsibilities, and negative lists. Adhere to reform and innovation, pay attention to refinement and operability, and strive for public results, so that the masses can see, understand and supervise. Guided by social needs and using the news media as the carrier, we will promote "Internet plus government affairs", expand public participation, and promote effective government governance.

(3) Work objectives. By 2020, the openness of government affairs will have reached a new level, and the negative list system for openness of government affairs will be actively and steadily implemented in accordance with the law, covering the whole process of the exercise of power and the whole process of government services. The level of openness and institutionalization, standardization and informatization will be significantly improved, and public participation will be high, so as to win more understanding, trust and support from the people with a more open and transparent government.

Second, promote transparency in government affairs

4. Making policy decisions more open. Public participation, expert demonstration, risk assessment, legality review, and collective discussion of decisions have been identified as legal procedures for major administrative decisions. Implement a pre-disclosure system for major decisions, involving the vital interests of the people, important reform programs, major policies and measures, and key projects that need to be widely known by the community, in addition to those that should be kept secret according to law, the draft decision should be published to the public before making decisions, and the basis for decision-making should be widely heard by the public through hearings, investigations, consultations, media communication and other means. The collection and adoption of views shall be made public in an appropriate manner. We will explore the system for stakeholders, the public, experts and the media to attend relevant government meetings, and enhance the transparency of decision-making. After the decision is made, the agreed matters and relevant documents shall be disclosed in a timely manner in accordance with the provisions.

5. Making implementation more open. Take the initiative to make public the implementation measures, implementation steps, division of responsibilities, and supervision methods of key reform tasks, important policies, and major engineering projects, publicize the achievements and follow-up measures according to the progress of the work, listen to public opinions and suggestions, strengthen and improve the work, and ensure that the implementation is in place. Governments at all levels and their working departments should do a good job of supervision and audit found problems and rectification and implementation of the public, accountability for inaction, slow action, disorderly action should also be disclosed to the public, and strengthen the implementation of implementation.

6. Promoting management transparency. We will comprehensively promote the disclosure of power lists, responsibility lists and negative lists, and establish a sound mechanism for dynamic adjustment and disclosure of lists. To implement the public disclosure system of administrative law enforcement, governments at all levels should, in accordance with their respective powers and functions, and in accordance with the principles of highlighting key points, being orderly in accordance with the law, and being accurate and convenient to the people, encourage law enforcement departments to disclose their responsibilities and powers, law enforcement basis, discretion benchmark, law enforcement process, law enforcement results, and relief channels, standardize administrative discretion, and promote fairness and justice in law enforcement. We will promote the disclosure of regulatory information, focusing on work safety, ecological environment, health and epidemic prevention, food and drugs, low-income housing, quality and price, land and resources, social credit, transportation, tourism market, operation of state-owned enterprises, and trading of public resources. We will make public the allocation and use of funds for people's livelihood, focusing on the implementation of targeted poverty alleviation and targeted poverty alleviation, and increase the disclosure of information on the targets of poverty alleviation, the allocation of poverty alleviation funds, and the use of poverty alleviation funds, and accept social supervision.

7. Making services more open. We will combine the physical government service center with the online office hall to promote the extension of government services to online handling. All regions and departments should fully disclose service matters, formulate and issue service guidelines, simplify and optimize service processes, so that the people will not go wrong, and work more clearly and more comfortably. Publish the list of intermediary services for administrative examination and approval, and disclose the name of the project, the basis for setting it, and the service time limit. We will promote public procurement of public services by the government and public private partnership (PPP) in providing public services. Vigorously promote the openness of public enterprises and institutions, and the competent departments of the industry should strengthen classified guidance, organize the compilation of a catalogue of open service matters, formulate and improve specific measures, and effectively assume the responsibilities of organization, coordination, supervision and guidance. By maximizing the convenience of enterprises and the masses, open up the government to serve the "last mile" of the masses.

8. Promoting disclosure of results. Administrative organs at all levels should take the initiative to make public the implementation of major decisions and policies, and make greater disclosure of the results of the implementation of the decisions and plans of the Party Central Committee and The State Council. We will promote the disclosure of development plans, government work reports, and the implementation of government decisions, focusing on development goals, reform tasks, and measures to improve people's livelihood. We will establish a sound system for tracking, giving feedback and evaluating major policy decisions. We will evaluate the effectiveness of policy implementation in a scientific way, using third-party evaluations, appraisals by professional organizations, and public opinion surveys to enhance the credibility of public disclosure of results, and win the trust of the people through our work performance.

9. Promoting information disclosure in key areas. Efforts should be made to promote the disclosure of government information in areas such as fiscal budgets and final accounts, allocation of public resources, approval and implementation of major construction projects, and construction of social welfare undertakings, and relevant departments should formulate implementation measures and clarify specific requirements. Administrative organs at all levels shall publish normative documents concerning the rights and obligations of citizens, legal persons or other organizations in accordance with government information disclosure requirements and procedures. The results of regulatory documents should be made public. Strengthen the release of information on emergencies, public security, and major epidemics, and the local authorities and departments responsible for the disposal of information are the first responsible persons for the release of information, and they should respond quickly, speak out in a timely manner, and release information dynamically according to the progress of the disposal.

Third, expand participation in government openness

10. Opening up government data. In accordance with the requirements of the Action Plan to promote the development of big data, we will implement the management of the list of government data resources, accelerate the construction of a unified open platform for national government data, formulate open catalogs and data collection standards, and steadily promote the sharing and opening of government data. Prioritizing the orderly opening of government data in areas such as people's livelihood, public services and market supervision. We formulated and implemented policies and opinions on steadily promoting the opening up of public information resources. We will support and encourage nongovernmental forces to make full use of government data resources, promote mass innovation, crowdsourcing, crowdsupport, and crowdfunding, and provide conditions for mass entrepreneurship and innovation.

11. Strengthen policy interpretation. Policy interpretation and policy making should be considered and arranged simultaneously. All regions and departments should give play to the role of experts, scholars and news media who are involved in policy making, familiar with relevant policies and business in relevant fields, and pay attention to the use of digitalization, charts and diagrams, audio and video, etc., to make policy interpretation more targeted, scientific and authoritative. For policies and regulations that involve a wide range of aspects, attract high public attention, are difficult to implement, and are highly professional, it is necessary to interpret them well through press releases, policy briefings, interviews, and published articles, and explain the policy background, objectives, and key points in a simple way. The governments of all provinces (autonomous regions and municipalities directly under the Central Government) and departments of The State Council should make full use of press conferences and policy briefings to interpret policies, leading cadres should take the lead in preaching policies, especially in the case of major emergencies and important social concerns, and the principal responsible persons should take the lead in giving interviews to the media, stating their positions and attitudes, issuing authoritative voices, and acting as the "first spokesperson". News media, news websites and research institutions should do a good job in interpreting major policies of the Party Central Committee and The State Council.

12. Expanding public participation. Through the openness of government affairs, the public can participate in the formulation, implementation and supervision of policies to a greater extent, and Huizhong intelligent policy implementation, continuous improvement of policies and improvement of work. We will study and explore the types and ways of public participation at different levels and in different fields, build a platform for interaction between the government and the people, and ask the people about politics, their needs, and their advice, so as to enhance public recognition and support for the work of the government. Make full use of the advantages of the Internet, actively explore new modes of public participation, and improve the response speed of government public policy formulation, public management, and public services.

13. Responding to social concerns. We will establish and improve mechanisms for collecting, evaluating, handling, and responding to public opinions on government affairs, strengthen supervision of responses to major public opinions on government affairs, and evaluate their effectiveness. For important public opinions, media concerns, emergencies and other hot issues involving the region and the department, authoritative information should be released in a timely manner in accordance with procedures, clarifying the facts, policies and measures, and the results of handling, and earnestly responding to concerns. Clearly respond to the subject in accordance with the law and regulations, implement responsibilities, and ensure that the voice is not lost and the position is not missing when dealing with major emergencies and social hot events.

14. Giving play to the role of the media. The news media should be used as a bridge between the Party and the government and the masses, and major news media should be used to release information in a timely manner, interpret policies, and lead public opinion. Arrange the heads of central and local media and news websites to participate in important activities and understand major decisions; Unimpeded channels for media coverage and actively facilitated media coverage. At the same time, it is necessary to give full play to the network communication power and social influence of new media such as news websites, commercial websites, micro-blogs and wechat, and mobile clients, so as to improve the pertinence and effectiveness of publicity and guidance.

Fourth, we will enhance our capacity for transparency in government affairs

15. Improving systems and norms. We established and improved a system for making government affairs more open, focused on elevating achievements in making government affairs more open to institutional standards, and promptly adjusted and cleaned up regulations that did not meet the requirements of the situation. We revised the Regulations on the disclosure of government information and improved the provisions on voluntary disclosure and disclosure of information upon application. We will establish an open mechanism to promote law-based administration, and encourage relevant departments to address irregularities in administrative behavior. We will establish and improve standards for the content, process, platform, and time limit of government transparency. Promote the standardization of the construction of government service centers, and unify the name, identification, entry of departments, handling of matters, and management services. Formulate guidelines for the development of government websites, and clarify requirements such as functional positioning, column setting, and content guarantee.

16. Establishing a negative list for public disclosure of government affairs. The governments of all provinces (autonomous regions and municipalities directly under the Central Government) and departments under The State Council shall actively and steadily draw up negative lists for the disclosure of government affairs in accordance with the law, specify the areas that will not be made public, include matters that endanger national security, economic security, public security and social stability into the negative list management, and adjust and update them in a timely manner. The negative list should be detailed and specific to facilitate inspection and supervision, and matters not on the negative list should in principle be disclosed in accordance with laws and regulations. We will improve the mechanism for reviewing confidentiality before making it public, standardize the procedures for reviewing confidentiality, properly handle the relationship between making government affairs public and keeping secrets, and effectively keep secrets that should be kept secret in accordance with the law.

17. Improving IT application. We will actively use big data, cloud computing, mobile Internet and other information technologies to make government affairs more open and centralized. Accelerate the promotion of "Internet plus government affairs", build an integrated Internet-based government service system, and implement online consultation, online handling, and electronic monitoring of approval and service matters through information sharing, connectivity, and business coordination, so as to benefit enterprises and facilitate the people. Promote the interconnection and sharing of credit information, and promote the construction of "credit China". We will make full use of new platforms such as government Weibo, wechat and government affairs clients to expand information dissemination, carry out online services, and enhance user experience.

(18) Strengthening the construction of government portal websites. Strengthen the role of government portal websites as the first platform for information disclosure, integrate the information resources of government websites, strengthen the coordination and linkage between government websites at all levels, strengthen the linkage with major central and local news media, major news websites and key commercial websites, make full use of new media means to broaden the channels of information dissemination, improve the functions, improve the system, and strengthen the content and technical support. The government website should be built into a more comprehensive information disclosure platform, a more authoritative platform for policy issuance, interpretation and public opinion guidance, and a more timely response to concerns and convenience service platform.

19. Focusing on education and training. Governments at all levels should openly include government affairs in the training subjects for civil servants, and rely on Party schools, administrative colleges, cadre colleges and other cadre education and training institutions at all levels to strengthen training for the staff of administrative organs, especially leading cadres, enhance their public awareness, and improve their ability to release information, interpret policies and respond to concerns. Formulate business training plans, carefully arrange training subjects and contents, organize and implement the training at different levels, strive to rotate the training of staff engaged in open government affairs across the country within three years, and support staff engaged in open government affairs to receive relevant continuing education. The competent departments of education shall encourage institutions of higher learning to set up courses on the openness of government affairs and train specialized talents in the openness of government affairs.

5. Strengthen safeguard measures

20. Strengthening organizational leadership. Party committees and governments at all levels should attach great importance to the openness of government affairs. Governments at all levels should, under the unified leadership of Party committees, take the lead in making government affairs more open, determine a government leader to be in charge, establish a sound coordination mechanism, clarify the division of responsibilities, and earnestly implement the work. The general offices (offices) of governments at all levels and their working departments are the departments in charge of the openness of government affairs. They are specifically responsible for organizing, coordinating, guiding, promoting, supervising and inspecting the openness of government affairs in their own regions and systems. They should integrate forces and resources in the openness of government affairs, strengthen communication and coordination with news media and news websites, and make overall guidance. Further rationalize the mechanism, clarify the working organization, and allocate full-time staff. When conditions permit, the openness of government affairs, government services, open government data, and supervision and management of public resource transactions should be considered and promoted in a coordinated manner. We should strengthen the funding guarantee for the openness of government affairs and create conditions for the smooth development of the work. We will encourage the introduction of social resources and the purchase of services to make government affairs more professional.

21. Strengthening assessment and oversight. We will incorporate the openness of government affairs into the performance appraisal system and increase the weight of scores. We will encourage and support third-party institutions to conduct independent and impartial assessments of the quality and effectiveness of government transparency. To guide the news media and government websites in publishing government information, interpreting policies and responding to concerns. We will give full play to the oversight role of NPC deputies, CPPCC members, democratic parties, people's organizations, the public, and the media in transparency of government affairs. Strengthen incentives and accountability, and commend the implementation of the work of openness in government affairs in accordance with relevant regulations; If the work of publicity is not fully implemented, it will be notified and criticized; Those who violate the relevant provisions on the disclosure of government affairs, fail to fulfill their obligations of disclosure, or disclose matters that should not be disclosed, and cause serious impact, shall be seriously investigated and held accountable according to law and regulations.

The General Office of the State Council shall formulate relevant implementation rules in accordance with these Opinions. All regions and departments should formulate specific implementation measures in light of actual conditions, refine tasks and measures, clarify the division of responsibilities, and earnestly implement them.
