The Ministry of Land and Resources of the People's Republic of China used to be the original department of The State Council responsible for the planning, management, protection and rational utilization of natural resources such as land resources, mineral resources and Marine resources. [1]
In March 2018, the Ministry of Natural Resources was established in accordance with the Institutional Reform Plan of The State Council approved by the first session of the 13th National People's Congress; The functions of the Ministry of Land and Resources, the National Development and Reform Commission, the Ministry of Housing and Urban-Rural Development, the Ministry of urban and Rural planning, the Ministry of Water Resources, the Ministry of grassland resources, the Ministry of Agriculture, the State Forestry Administration of forest, wetland and other resources, the investigation and ownership registration of management responsibilities. The responsibilities of the State Oceanic Administration and the responsibilities of the State Bureau of Surveying, Mapping and Geographic Information shall be integrated and established Ministry of Natural Resources, People's Republic of China As a department of The State Council; No more Ministry of Land and Resources. On March 10, 1998, the third plenary meeting of the first session of the ninth National People's Congress voted to adopt a decision on the institutional reform plan of The State Council. According to the decision, the Ministry of Land and Resources will be jointly established by the Ministry of Geology and Mineral Resources, the State Land Administration, the State Oceanic Administration and the State Surveying and Mapping Bureau. The State Oceanic Administration and the State Surveying and Mapping Administration shall be retained as the state administration of the Ministry of Land and Resources. [1] [3]

According to the Notice of The General Office of the State Council on Printing and Distributing the Provisions on the Functional Allocation of the Internal Organs and Personnel Establishment of the Ministry of Land and Resources (State Office of Development (1998) No. 47), the main responsibilities of the Ministry of Land and Resources are:
(1) To formulate relevant laws and regulations, promulgation of land resources, mineral resources, Marine resources (except Marine fishery resources under the responsibility of the Ministry of Agriculture, the same below) and other natural resources management rules; To be responsible for administrative review in accordance with relevant provisions; To study and formulate policies for the management, protection and rational utilization of land, mineral and Marine resources; To formulate technical standards, procedures, norms and methods for the management of land resources, mineral resources and Marine resources.
(2) To organize the preparation and implementation of national territory plans, general plans for land utilization and other special plans; To participate in the examination and approval of general urban plans submitted to The State Council for examination and approval, to guide and examine local general plans for land use; To organize the investigation and evaluation of mineral resources and Marine resources, and formulate plans for the protection and rational utilization of mineral resources and Marine resources, geological exploration plans, geological disaster prevention and control plans and geological heritage protection plans.
(3) To supervise and inspect administrative law enforcement and implementation of plans for land, mineral and Marine resources by land and resources departments at all levels; To protect the legitimate rights and interests of owners and users of land, minerals and Marine resources, undertake and organize the mediation of major disputes over ownership, and investigate and punish major cases of violations of the law.
(4) To formulate and implement policies for the special protection of cultivated land and the encouragement of the development of cultivated land, exercise control over the use of farmland, organize the protection of basic farmland, guide the development of unused land, land consolidation, land reclamation and supervision of cultivated land development, and ensure that the area of cultivated land can only be increased, not reduced.
(5) Formulate cadastral management measures, organize land resource surveys, cadastral surveys, land statistics and dynamic monitoring; To guide the work of land ownership determination, urban and rural cadastre, land grading and registration.
(6) To formulate and, in accordance with regulations, organize the implementation of administrative measures for the transfer, leasing, valuation, investment, transfer, transaction and government acquisition of land use rights, formulate a catalogue guide for the allocation and use of state-owned land and township (town) village land management measures, and guide the transfer and management of rural collective non-agricultural land use rights.
(7) To guide the benchmark land price, calibrate the evaluation of land price, examine the qualifications of evaluation institutions engaged in land evaluation, and confirm the price of land use rights. To undertake the examination and approval of all types of land for examination and approval by The State Council.
(8) to administer according to law the examination and approval, registration, certification, examination and registration of transfer of mineral resources exploration rights and mining rights; To examine and approve foreign cooperation blocks according to law; To undertake the management of mineral resources and reserves, and to manage the exchange of geological data; To administer the geological exploration industry according to law, examine and determine the qualifications of geological exploration units, and administer the geological exploration results; To administer the collection and use of mineral resources compensation fees in accordance with regulations. To examine and approve the qualifications of evaluation institutions engaged in the evaluation of exploration and mining rights, and confirm the evaluation results of exploration and mining rights.
(9) To organize the monitoring, prevention and control of geological disasters and the protection of geological relics; To administer the exploration and evaluation of hydrogeology, engineering geology and environmental geology according to law, monitor and supervise the prevention of excessive exploitation and pollution of groundwater, and protect the geological environment; To identify geological relic reserves such as paleontological fossil sites and standard geological profiles of important value.
(10) To arrange, supervise and inspect the geological exploration fees and other funds allocated by the State finance.
(11) To organize foreign cooperation and exchanges on land, mineral and Marine resources.
(12) To undertake other matters assigned by The State Council. [4]

According to the Notice of The General Office of the State Council on Printing and Distributing the Provisions on the Functional Allocation of the Internal Organs and Personnel Establishment of the Ministry of Land and Resources (State Office of Development (1998) No. 47), the Ministry of Land and Resources has 14 functional departments (offices) :
(1) General Office
Organize and coordinate the daily work of the department, responsible for the drafting of relevant documents, the organization of important meetings, message processing, secretarial affairs, information synthesis, news and publicity, archives, letters and visits, confidentiality, security, reception, financial and asset management of the department, etc.
(2) Department of Policies and Regulations
To organize the drafting of laws and regulations on land resources, mineral resources and Marine resources; To organize and coordinate related legislative work within the Ministry; To organize publicity and education on relevant laws and regulations; Handling relevant administrative reconsideration matters; To study and draft comprehensive policies on land, mineral and Marine resources.
(3) Department of Planning
To organize the study of policies and measures for the comprehensive development and improvement of national land and key areas; to draft and formulate national and regional land plans, general plans for land utilization, plans for the protection and rational utilization of mineral and Marine resources, and plans for the geological environment; Formulation of land supply policies; To guide and examine special plans such as basic farmland protection plans, land reclamation plans, land consolidation plans, unused land development plans and local general plans for land use, and to participate in the examination and approval of general urban plans submitted to The State Council for examination and approval.
(4) Department of Finance
To organize the formulation of relevant financial and accounting systems, to supervise and administer the financial affairs and state-owned assets of the units directly under them; To undertake the financial management of the geological exploration fees and other funds allocated by the State finance; To conduct financial supervision and administration of administrative charges administered by the Ministry of Land and Resources; To supervise the collection and use of mineral resources compensation fees.
(5) Department of Cultivated Land Protection
To formulate policies for the special protection and encouragement of cultivated land development, policies for the protection and improvement of cultivated land, measures for the management of the conversion of cultivated land, and provisions for the development of unused land, land consolidation, land reclamation and cultivated land development; To guide the control of agricultural land use and organize the protection of basic farmland.
(vi) Division of Cadastral Management
To formulate cadastral management measures, formulate technical specifications and standards for land survey, dynamic monitoring, cadastral survey and statistics, and organize land resource status survey, dynamic monitoring, cadastral ownership survey, change survey and statistics; To formulate rules and methods for the settlement of land ownership disputes, registration, certification and mediation of land ownership disputes, and undertake the mediation of major land ownership disputes.
(7) Department of Land Use Management
To formulate administrative measures for the transfer, leasing, valuation, investment, transfer, transaction and government acquisition of land use rights, formulate catalogs and guidelines for the allocation and use of state-owned land and township (town) village land management measures, and guide the transfer and management of rural collective non-agricultural land use rights. To guide the benchmark land price, calibrate the evaluation of land price, guide the qualification of audit and evaluation institutions engaged in land evaluation, and confirm the price of land use rights.
(8) Department of Mineral Development and Management
To conduct mining examination and approval registration and license issuance and examination and registration for the transfer of mining rights according to law; To handle major mining disputes and disputes according to law; To examine and verify the qualifications of the evaluation institutions engaged in the evaluation of mining rights, and to examine the evaluation results of mining rights funded by the State; To supervise and administer the development, utilization and protection of mineral resources according to law, and to collect compensation fees for mineral resources according to law.
(9) Department of Mineral Resources and Reserves
To organize the formulation of measures, standards, procedures and norms for the management of mineral resources reserves; To organize the establishment and improvement of the expert system of mineral resources reserve evaluation; To undertake the management of mineral resources and reserves and the collection and delivery of geological data; Organize the analysis of the situation of supply and demand of mineral resources; To study and formulate policies on mineral resources.
(x) Department of Geological Environment
To formulate measures for the management of geological resources such as geological relics and geological disasters; To organize the formulation and implementation of plans for the prevention and control of geological disasters and the protection of geological relics such as landslides, collapses, debris flows, land subsidence and subsidence, and to supervise and inspect the implementation; To organize and coordinate the prevention and control of major geological disasters; To guide the monitoring, evaluation and prediction of geological hazards and groundwater dynamics; To organize the identification of sites of paleontological fossils, standard geological profiles and other geological relic reserves of important value, and to organize the protection of geological relics and the prevention and control of geological disasters.
(11) Division of Geological Exploration
To organize the formulation of standards, rules and norms for geological exploration; To organize the investigation and evaluation of mineral and Marine resources, draft and formulate geological exploration plans and supervise and inspect their implementation; To conduct examination, approval, registration and certification of exploration and the examination and registration of the transfer of exploration rights according to law; To examine and approve blocks for foreign cooperation in exploration and mining; To mediate major geological exploration disputes and disputes according to law; To examine and verify the qualifications of the evaluation institutions engaged in the evaluation of exploration rights, and organize the confirmation of the evaluation results of exploration rights funded by the state.
(12) The Bureau of Supervision of Law Enforcement
To organize the supervision and inspection of the implementation and compliance with the state laws and regulations on land resources, mineral resources and Marine resources; to formulate regulations on land law enforcement supervision and investigation of land violation cases; to organize the supervision and inspection of land planning, conversion of agricultural land, land expropriation, disposal of land assets and transactions of land use rights; to organize the investigation and investigation of major land violation cases according to law.
(XIII) Division of International Cooperation and Science and Technology
To formulate work plans for land and resources science and technology and foreign affairs, to supervise and inspect the implementation of major science and technology projects and foreign affairs work; To promote scientific and technological progress and disseminate new scientific and technological achievements; To organize cooperation and exchanges between governments and relevant international organizations, to arrange reception work for foreign affairs and to handle relevant procedures for people going abroad.
(14) Department of Personnel and Education
To undertake the organizational establishment and personnel management of the department and the units directly under it; To draft and formulate educational development plans to guide the construction of educational disciplines and specialties; Organize training work.
