The Ministry of National Defence of the People's Republic of China is a department of The State Council of the People's Republic of China. It was established by resolution of the First Session of the First National People's Congress in September 1954 and is a department of the People's Republic of China.

According to the Constitution of the People's Republic of China, The State Council directs and administers the development of national defense. The State Council establishes the Ministry of National Defense, and all military work that requires the responsibility of the government shall be carried out through the Ministry of National Defense or in the name of the Ministry of National Defense after corresponding decisions are made by The State Council. The Ministry of National Defense is under the leadership of the Central Military Commission as well as The State Council.
