In accordance with the Constitution, the People's Republic of China establishes the Supreme People's Court, local people's courts at various levels and special people's courts. The Supreme People's Court is the highest judicial organ of the People's Republic of China. It is responsible for hearing all types of cases, formulating judicial interpretations, supervising the judicial work of local people's courts at various levels and special people's courts, and administering the judicial administration of the courts throughout the country in accordance with the scope of its duties as defined by law. In accordance with the Constitution, the Organic Law of the People's Courts and relevant laws, the Supreme People's Court, as the highest judicial organ of the State, tries the following cases:
(1) To try cases of first instance over which the law provides for its jurisdiction and which it considers should be tried by itself;
(2) Hearing appeals, protests, applications for retrial and appeals against judgments or orders of higher people's courts and special people's courts;
(3) Hearing the cases of protest filed by the Supreme People's Procuratorate in accordance with the procedures for trial supervision;
(4) To approve death penalty cases other than those decided by the Court;
5. Try cases of state compensation according to law and decide on state compensation;
(6) Cases in which a penalty below the statutory penalty is approved.
In addition to adjudicating cases, the Supreme People's Court is also responsible for the unified management and coordination of the enforcement work of courts across the country. At present, courts across the country accept a large number of applications for enforcement cases every year. These cases are mainly enforced by local people's courts. The Supreme People's Court shall establish an Executive Board to be responsible for the administration, supervision and coordination of this work.
