People's Republic of China The Ministry of Finance is the People's Republic of China The State Council Ministries and commissions are at the ministerial level. Its predecessor was the Ministry of Finance of the Central People's Government established on October 1, 1949.
The main functions of the Ministry of Finance include formulating fiscal and taxation development strategies, plans, policies and reform programs and organizing their implementation. (12) Undertake multilateral and bilateral financial dialogues with relevant countries and regions assigned by The State Council, and carry out international exchanges and cooperation in the field of finance and economics. (16) Transformation of functions.
1. 3. Forestall and defuse local government debt risks. (17) Division of responsibilities.
1. Division of tax administration responsibilities. (1) The Ministry of Finance is responsible for putting forward tax legislation proposals, and proposing with the State Administration of Taxation and other departments suggestions on tax increases and reductions, tax rate adjustments, tax reductions and exemptions. The Ministry of Finance is responsible for organizing the drafting of tax laws, draft administrative regulations, implementation rules and tax policy adjustment plans, while the State Administration of Taxation specifically drafts tax laws, draft administrative regulations and implementation rules and puts forward tax policy suggestions, which are jointly reported and issued by the Ministry of Finance and the State Administration of Taxation after deliberation. The State Administration of Taxation shall be responsible for the interpretation of tax collection and administration and general tax administration issues in the implementation of tax laws and administrative regulations, and shall later file with the Ministry of Finance. The State Administration of Taxation and other departments, in accordance with the relevant provisions on the centralized collection of non-tax income by the Treasury, are responsible for the declaration and collection of non-tax income, unified accounting, payment inspection, arrearage recovery and illegal punishment, etc., and the information on collection of non-tax income items is shared with the Ministry of Finance in a timely manner.
3. Division of responsibilities for state-owned assets management in central administrative institutions. The Ministry of Finance shall be responsible for formulating rules and regulations for the management of state-owned assets of administrative institutions, and shall be responsible for organizing implementation, supervision and inspection. The National Government Offices Administration is responsible for the management of state-owned assets of central administrative institutions (i.e., departments under The State Council, institutions directly under The State Council, the Supreme People's Court, the Supreme People's Procuratorate, relevant people's organizations, etc.) and their service centers, as well as the definition of property rights, inventory and registration, and disposal of assets. To formulate specific systems and methods for the management of state-owned assets by central administrative institutions and organize their implementation, and accept the guidance, supervision and inspection of the Ministry of Finance. (5) Department of Taxation. To organize the drafting of tax laws and administrative regulations and rules for their implementation. To put forward proposals on increasing or decreasing tax types, adjusting tax rates of tax items, reducing or exempting taxes, and adjusting tax policies. To undertake work related to foreign tax negotiations, and formulate international tax agreements and agreement models. Carry out tax source investigation and analysis. (6) Department of Customs (Office of Tariff Commission of The State Council). To organize the drafting of customs laws and administrative regulations and rules for their implementation.
